GENERAL TERMS AND CONDITIONS OF RENTAL
Effective upon completion of an online booking.
These General Terms and Conditions ("Terms") govern all stand-up paddleboard ("SUP") rentals and related services provided by SUP Züri, operated by Jim Parker, Heimatstrasse 7, 8008 Zurich, Switzerland ("SUP Züri", "we", "us", or "the Lessor").
By making an online booking, completing payment, collecting rental equipment, or using any rented equipment, the customer ("you" or "the Lessee") acknowledges that they have read, understood, and agreed to be legally bound by these Terms.
ONLINE BOOKING AND CONTRACT INFORMATION
1.1 During the online booking process, you must actively confirm acceptance of these Terms by selecting the relevant acceptance checkbox before payment can be completed.
1.2 By selecting the acceptance checkbox and submitting payment, you make a legally binding request to enter into a rental agreement and confirm that you accept these Terms in full.
1.3 A binding rental agreement is formed once the booking process has been successfully completed and a booking confirmation has been issued by SUP Züri.
1.4 Electronic acceptance records, booking confirmations, and payment records shall constitute sufficient evidence that these Terms have been accepted.
1.5 Where acceptance has been confirmed during the booking process, you waive any right to claim that these Terms were not reviewed, read, or understood.

The Lessee is the individual whose details are submitted during the booking process or who collects the rental equipment.
APPLICATION OF THESE TERMS
3.1 These Terms apply to all rentals and related services provided by SUP Züri.
3.2 Rental equipment may include SUP boards, paddles, life jackets, leashes, dry bags, waterproof phone cases, and any other accessories supplied by SUP Züri (collectively referred to as the "Equipment").
3.3 By booking, paying for, collecting, or using the Equipment, you agree that these Terms form an integral part of the rental agreement.
3.4 SUP Züri reserves the right to refuse any booking or rental request at its sole discretion.
ELIGIBILITY, AGE REQUIREMENTS AND SWIMMING ABILITY
4.1 Equipment may be rented by individuals aged 16 years or older.
4.2 Any person under the age of 16 may only participate when accompanied throughout the rental period by a responsible adult aged 18 years or older.
4.3 The accompanying adult must be named in the booking and shall remain responsible for the minor at all times while collecting, using, and returning the Equipment.
4.4 The accompanying adult expressly accepts full responsibility and liability for the minor's conduct, safety, supervision, compliance with these Terms, and use of the Equipment.
4.5 The accompanying adult confirms that the minor is capable of safely participating in the activity, possesses adequate swimming ability for open-water conditions, and is physically fit to use the Equipment.
4.6 All participants under the age of 16 must wear a certified life jacket at all times while on or near the water.
4.7 The accompanying adult shall be jointly and severally liable with the minor for any loss, damage, injury, costs, claims, or liabilities arising from the minor's use of the Equipment or breach of these Terms.
4.8 SUP Züri reserves the right to refuse participation where no responsible adult aged 18 years or older is present or where SUP Züri reasonably considers participation to be unsafe.
IDENTIFICATION AND COLLECTION
5.1 Equipment will only be released upon presentation of a valid booking confirmation.
5.2 The booking confirmation provided after online payment serves as proof of entitlement to collect the Equipment.
RENTAL PERIODS AND PRICING
6.1 Rentals are available for periods between one and eight hours.
6.2 The rental period begins at the scheduled collection time and ends at the agreed return time stated in the booking.
6.3 Rental prices are displayed during the booking process and form part of the booking contract.
6.4 Unless otherwise stated, rental prices include one paddle and one life jacket per board.
6.5 Optional accessories may be offered for an additional charge.
6.6 Overnight rentals are not available.PAYMENT
7.1 Full payment must be made at the time of booking through the approved online booking platform.
7.2 Accepted payment methods are displayed during checkout.
7.3 Equipment will not be released unless payment has been successfully received and confirmed.
7.4 Gift vouchers are redeemable during the operating season, subject to availability and any applicable voucher conditions.
COLLECTION AND RETURN OF EQUIPMENT
8.1 Equipment must be collected from and returned to the designated SUP Züri collection point identified in the booking confirmation.
8.2 Equipment delivery to alternative locations is not offered.
8.3 Customers should arrive at least five minutes before the scheduled start time.
8.4 Late arrival does not extend the booked rental period.
8.5 Equipment must be returned directly to SUP Züri personnel and must not be left unattended.
LATE RETURNS
9.1 You are responsible for ensuring Equipment is returned by the agreed return time.
9.2 Personal circumstances, traffic delays, transport disruptions, accidents, or similar events do not excuse late return.
9.3 A late return fee of CHF 7.50 shall apply for every commenced 30-minute period after the scheduled return time.
9.4 If a delayed return causes loss of a subsequent booking or additional losses, SUP Züri reserves the right to recover those losses in addition to any late return fees.
9.5 Rental extensions are not guaranteed and require prior approval from SUP Züri before the original rental period expires.
EARLY RETURNS
10.1 Rental fees apply to the full booked rental period.
10.2 No refund, credit, or partial reimbursement will be provided if Equipment is returned before the scheduled end of the booking, regardless of the reason.
CANCELLATIONS AND WEATHER CONDITIONS
11.1 Cancellation requests must be submitted by email or WhatsApp.
11.2 Cancellations received at least 12 hours before the scheduled start time are eligible for either a full refund or a free rebooking.
11.3 Cancellations made less than 12 hours before the scheduled start time, or failure to attend, are non-refundable.
11.4 SUP Züri may, at its sole discretion, issue a goodwill voucher in place of a refund.
11.5 Where weather or water conditions are considered unsafe for SUP activities, including storm warnings or sustained winds exceeding approximately 25 km/h, SUP Züri may cancel the booking.
11.6 In such cases, customers will be offered either a full refund or a rescheduled booking.
11.7 Refund of the rental fee shall be the customer's sole remedy in the event of weather-related cancellation by SUP Züri.
EQUIPMENT CONDITION AND HANDOVER
12.1 Equipment is supplied in a ready-to-use condition.
12.2 You must inspect the Equipment upon collection and immediately report any visible damage, defects, or missing items before entering the water.
12.3 Failure to report any issue before use constitutes acceptance that the Equipment was received in satisfactory condition.
12.4 If a defect or problem becomes apparent during use, you must cease using the Equipment as soon as safely possible and notify SUP Züri without delay.
CUSTOMER RESPONSIBILITIES
13.1 You are solely responsible for complying with all applicable laws, regulations, and local navigation rules relating to SUP use on Lake Zurich.
13.2 This includes, without limitation:
Carrying or wearing life jackets as required by law.
Avoiding restricted, protected, or prohibited areas.
Giving priority to commercial and larger vessels.
Respecting nature reserves, reed zones, spawning areas, and designated swimming zones.
Observing storm warning systems and official safety notices.
Complying with all local navigation and waterway regulations.
13.3 Equipment must be used carefully and only within the user's skill level.
13.4 Equipment must not be dragged across rough or abrasive surfaces including asphalt, gravel, stones, or concrete.
13.5 Manufacturer weight limits and operating instructions must always be respected.
13.6 Use of Equipment while under the influence of alcohol, drugs, medication, or any substance affecting judgement, coordination, or reaction times is strictly prohibited.
13.7 Equipment may not be lent, assigned, transferred, or sub-rented to any third party.
13.8 Any waste generated during use must be removed and disposed of responsibly.
13.9 Equipment must be returned reasonably clean and free from excessive dirt or contamination.
SAFETY AND ASSUMPTION OF RISK
14.1 SUP Züri provides rental equipment only and does not provide guiding, instruction, supervision, rescue services, monitoring, or safety oversight.
14.2 You are solely responsible for assessing whether conditions are suitable for your intended activity.
14.3 Any route suggestions, maps, marketing material, or website content are provided for general information only and do not constitute safety advice.
14.4 You are responsible for checking weather forecasts, lake conditions, navigation warnings, and local regulations before commencing any activity.
14.5 Responsibility for the safe and lawful use of the Equipment passes entirely to you upon collection.
14.6 You acknowledge and accept the inherent risks associated with watersports and open-water activities, including but not limited to drowning, collisions, injury, changing weather conditions, equipment misuse, and physical exertion.
14.7 In the event of an emergency, you must contact the appropriate emergency services directly.
DAMAGE, LOSS AND REPLACEMENT LIABILITY
15.1 You are fully responsible for the Equipment from the time it is handed over until it is returned directly to SUP Züri.
15.2 This responsibility includes loss, theft, damage, excessive contamination, misuse, or unauthorised modification.
15.3 If a booking includes multiple participants, the person making the booking remains jointly and severally liable for all Equipment included in that booking.
15.4 Where a booking includes multiple participants, all individuals who collect or use Equipment under that booking are deemed to have read, understood, and accepted these Terms in full. The person making the booking confirms that they have brought these Terms to the attention of all participants included in the booking and that all participants have agreed to be bound by them prior to collecting or using any Equipment.
15.5 In the event of loss, theft, non-return, or irreparable damage, the following replacement charges apply:
SUP Board: CHF 500.00
Paddle: CHF 80.00
Life Jacket: CHF 50.00
Dry Bag: CHF 30.00
Waterproof Phone Case: CHF 15.00
15.6 SUP Züri shall determine, acting reasonably, whether Equipment is repairable or requires replacement.
15.7 Where a repair is considered unsuitable for continued safe rental use, the applicable replacement charge shall apply.
15.8 You agree to indemnify and hold SUP Züri harmless against claims, damages, costs, fines, losses, and legal expenses arising from your use of the Equipment.
LIMITATION OF LIABILITY
16.1 SUP Züri warrants only that Equipment is operational and fit for rental use at the time of handover.
16.2 To the fullest extent permitted by Swiss law, SUP Züri excludes liability for indirect, consequential, incidental, or economic losses, including loss of profit.
16.3 Nothing in these Terms excludes liability where such exclusion is prohibited by law, including liability arising from wilful misconduct, gross negligence, or legally non-excludable personal injury claims.
16.4 SUP Züri accepts no responsibility for losses, injuries, or damages arising from:
Failure to follow safety requirements;
Adverse weather or water conditions;
Force majeure events;
Improper or unlawful use of Equipment;
Use while impaired by alcohol or drugs;
Overloading of Equipment;
Breach of navigation rules;
Conduct of third parties; or
Loss of personal belongings, including items stored in waterproof bags or cases.
16.5 Customers are responsible for arranging their own accident, medical, liability, travel, or personal insurance cover.
FORCE MAJEURE
17.1 SUP Züri may cancel, suspend, or terminate a booking where performance is prevented by circumstances beyond its reasonable control.
17.2 Such circumstances include, but are not limited to, severe weather, government restrictions, emergency warnings, public safety concerns, natural events, or other force majeure situations.
17.3 In such circumstances, any prepaid rental fees will be refunded.
17.4 No further compensation shall be payable.DATA PROTECTION
18.1 Personal information is processed in accordance with applicable Swiss data protection legislation.
18.2 Personal data is collected only for booking administration, customer service, fraud prevention, legal compliance, and related operational purposes.
18.3 Marketing communications will only be sent where consent has been provided and may be withdrawn at any time.
18.4 Further information regarding data processing is available in the SUP Züri Privacy Policy.
GOVERNING LAW AND JURISDICTION
19.1 These Terms and any dispute arising from them shall be governed exclusively by the laws of Switzerland.
19.2 The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
19.3 The courts having jurisdiction at the registered place of business of SUP Züri in Zurich, Switzerland, shall have exclusive jurisdiction over all disputes arising out of or in connection with these Terms.
SEVERABILITY
20.1 If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain fully effective.
20.2 Any invalid provision shall be replaced, interpreted, or modified to the minimum extent necessary to achieve a lawful result that most closely reflects the original commercial intention.
CUSTOMER ACKNOWLEDGEMENT
By completing an online booking, collecting Equipment, or using Equipment supplied by SUP Züri, you confirm that:
You meet the applicable age requirements or are accompanied by a responsible adult.
